Expulsion: Zuma threatens ANC with court action

Former President Jacob Zuma has issued a letter of demand to the African National Congress (ANC), presenting an ultimatum for the reinstatement of his membership by January 31, or he will pursue legal action. In the correspondence addressed to the party, Zuma’s attorney, Thabo Kwinana, raised both procedural and substantive issues concerning the actions taken by the ANC’s National Disciplinary Committee (NDC) and the National Disciplinary Committee of Appeal (NDCA).

The letter asserts that Zuma’s expulsion was “not procedural and invalid,” highlighting irregularities that an independent legal review would likely support. Currently, Zuma leads the uMkhontho weSizwe Party (MKP), which has posed significant challenges for the ANC since the national elections last year.

Zuma’s representatives argue that the ANC’s actions contravene both the organization’s constitution and the Constitution of South Africa. The letter demands that the ANC take immediate steps to provide a reasoned ruling from the NDCA, supply the complete record of the NDC/NDCA proceedings along with all relevant documents and correspondence, or alternatively, reverse the expulsion ruling without delay, ensuring compliance with both the ANC Constitution and the Constitution of the Republic.

It further states that should the ANC fail to comply by January 31, 2025, Zuma will initiate all necessary legal actions to protect his rights regarding the matters at hand, without any additional notice to the ANC.

Zuma, a member of the ANC for 65 years, has expressed apprehensions regarding the behavior of ANC Secretary-General Fikile Mbalula, who is alleged to have intimidated and victimized Zuma’s representative, Tony Yengeni. This situation has raised significant concerns about the internal processes of the ANC and the treatment of its members.

The JG Zuma Foundation has called upon the ANC to emphasize fairness, consistency, and adherence to its foundational principles, ensuring that all members are safeguarded against selective disciplinary measures or factional retribution. Mbalula, at the conclusion of the previous year, declared that the ANC would not reinstate Zuma, asserting that he had sealed his own fate by establishing the MKP.
